The following general terms and conditions apply to legal transactions (rental agreements) between the tenant(s)/customer(s) and The rental property.
1. RESERVATION
There are several ways to make a reservation, either directly or through an intermediary.
Reservations for overnight stays are also made through on-line travel agents (booking.com, etc.) or through direct inquiry (e-mail, website form, telephone conversation).
We offer you two ways of booking our capacity through our website. The first is via e-mail, whereby you send us an inquiry, and we provide you with an offer. The inquiry or our offer on their own are not considered a confirmed reservation, as the essential condition for the validity of the application is your confirmation of the reservation with advance payment or payment of the guarantee for the confirmation of the offer. If we do not receive such confirmation, the reservation will be deemed to never have been made.
In any case, the guest undertakes to provide us with an active e-mail address or other contact information when submitting the reservation and to authorise us to use it for the purposes of notification and verification in relation to the reservation.
2. CHANGE OF INFORMATION:
he guest undertakes to provide us with a right personal data. Zhe cahne of personal data can be made upon 4 days befor registration. Later every change cost 25 EUR. Any other changes are subject to the cancellation conditions in accordance with item CANCELLATION.
3. BOOKING TENANT:
The minimum age for tenants is fixed at 18 years. The tenant must be present on site during the entire rental period. The lessee shall be liable for the correctness of the information given in the lease agreement. The sole presence of persons under the age of 18 is not permitted and may result in the expulsion of this person. Parents are liable for their children.
4. RENTAL AGREEMENT: T
he rental object can only be used by those persons who are registered in the rental agreement. It is the responsibility of the hirer to check that all information is in accordance with the booked trip after receiving the travel documents. In case of doubt, contact the booking center. There is a maximum number of persons allowed to stay in each accommodation unit at one time. A subletting of the rental object to third parties is prohibited.
5. RENTAL PRICE:
The rental price include rent for mobile house, amenities, beddings, linen. The price does not include the visitor‘s tax and any registration fees and other fees of the campsite. All price are always easily accessible on the website www.kolpa.tavio.si.
6. PAYMENT:
You will receive a pro forma invoice at the e-mail address once you have confirmed your order. The payment deadline and bank details are indicated in the confirmation letter. Tavio. Tjaša Havnik s.p. reserves the right to change its price list without prior publication.
Within 10 days the deposit of 30% of the total amount is to be paid, the balance is due at the latest 14 days before the start of the holiday. If we do not receive a deposit or final payment, we reserve the right to cancel the booking for a fee based on the cancellation conditions. For short-term bookings the total amount is to be paid immediately after the rental sent.
7. RESCISSION OF THE LESSOR:
If the rental object is not available without the landlord‘s fault, for whatever reason (average, storm damage, fault of the previous tenant, etc.), the landlord is entitled to provide a replacement rental object of the same size at the agreed rent and time or to rescind the concluded rental contract. In this case, all advance payments and deposits would be refunded by the lessor. However, the tenant may not make any claims for damages against the landlord.
8. CANCELLING THE RESERVATION:
The guest has the right to cancel the reservation under the terms and conditions of the confirmation letter. The cancellation must be sent in writing or by e-mail by the deadline specified in the confirmation letter.
The following cancellation rates apply:
• No show on the day of arrival: 100% of the rental
• Cancellation up to 15 days before the start of the rental period: free cancelation
• Cancellation from the 14th day before the start of the rental period: 100% of the rental
*in case of non refundable price, the cancellation rates is 100 %.
9. CHECK-IN AND CHECK-OUT TIMES
Check-in time is at or after 3 pm.
Check-out time is until 10 am.
Upon arrival the guest must register at reception by presenting ID (an identity card or passport, and birth certificates for new-borns).You get the key for the mobile house by the reception.
10. TAKEOVER OF THE RENTAL OBJECTS:
The mobile home is cleaned only on departure. Additional cleaning may always be ordered and is charged according to the regular valid price list. The lessee is obliged to handle the rented object properly and carefully. When leaving the rental property, it shall be insured against storms (close windows, car door and awning).
11. RETURN OF THE RENTAL OBJECTS:
The rental object must be vacated by 10.00 am local time (morning). Empty trash canisters if necessary; wash dishes and put them away again, empty the refrigerator, dispose of rubbish; lock the rented property, place the table, chairs and parasols as you found them when you moved into the rented property; return the key. Any damage exceeding normal wear and tear will be paid by the guest who caused the damage. This includes, but is not limited to: furniture breakage, inventory breakage or misappropriation, burns on furniture and curtains, stains resulting from non-cleanable materials, etc.
12. HOUSE RULES OF THE CAMPSITE:
The tenant is contractually bound to the respective house rules of the campsite. Violation of the house rules may result in expulsion. No claims can be made against the landlord. The landlord is not liable for matters concerning the campsite that are beyond the landlord‘s control. Due to seasonal and infrastructural reasons there may be fluctuations in the water and electricity network. WLAN and TV reception cannot be guaranteed. The rental contract usually includes a parking space for one car. The parking space is not necessarily next to the rental property. In this case the car parking space will be allocated by the campsite. The tenant agrees that the instructions of the campsite staff – in case of an impending eviction – must be followed.
INSURANCE:
The landlord takes out a partial coverage insurance for the rental object. The renter is liable for damages caused by himself in the amount of the deductible (up to € 360,-).
13. ACCIDENT:
In case of accidents of any kind the lessor must be informed immediately. The names of witnesses must be established
14. TRAVEL INTERRUPTION AND COMPLAINT:
Please contact the local representative of the landlord immediately
Defects of any kind must be reported immediately and without delay to the landlord‘s representative on site in order to make improvements. Subsequent defects not reported on site cannot be considered. Complaints must always be noted in writing and sent to info@tavio.si. Facilities and activities at the campsite may be limited or completely closed, especially during the low season. This is at the discretion of the campsite and the lessor is not liable for this.
15. LOST ITEMS, THEFT, DAMAGE:
The lessor is not liable for items forgotten by the tenant. However, if forgotten items are recovered, the lessor will send them to the tenant at the tenant‘s expense, if the tenant so wishes. The costs and risks/liabilities for damage and loss of the objects shall be borne by the hirer. The lessor cannot be held liable for personal belongings of the renter as well as cars, bicycles etc. (e.g. in case of theft or damage by natural forces).
16. PETS:
Pets are not allowed (with the exception of guide dogs).
17. SMOKING.
Smoking is not allowed in the accommodation facilities
18. PERSONAL DATA AND DATA PROTECTION:
The customer agrees that his personal data (name, address, date of birth, telephone number, bank account details) will be stored by the lessor for the purpose of carrying out the booking, insofar as this is necessary. The customer has the right to request information about his stored personal data at any time.
By the registration, your personal data, which you must provide in order to obtain the ccommodation service, is stored by reception of BIG BERRY resort as the controller in its database for the purpose of fulfilling the accommodation contract and legal obligations related to the hospitality industry. Data to be collected (data may change depending on changes in regulations): First name and surname, Place, Cuntry and date of birth, nationality, ID number and type, Title, Date and time of arrival at or departure from the facility, Gender, Basis for exemption from tourist tax or for a tourist tax reduction, Personal phone number if the guest is travelling in and accessing the facility with a personal car.
The request for information must be made in writing to the lessor. In the course of this he must also prove his identity in a suitable form. Furthermore, the customer has the right at any time to demand the correction or deletion of his personal data upon justified request. The client must submit the request for deletion by e-mail to info@tavio.si, including the name and address and the reason for correction or deletion. Personal data will only be passed on to third parties by the lessor if this is necessary for the purpose of processing the contract, if they are legally obliged to pass on the data or if the client has explicitly consented to this. If the use of data is not provided for by law, each person concerned has the right to object to the use of his data by the client of the data application due to violation of predominant secrecy interests worthy of protection, which result from his special situation.
19. CHANGES TO THE GENERAL TERMS AND CONDITIONS
The owner reserves the right to make any changes, in whole or in part, to any part of the General Terms and Conditions without specific notice and without limitation. The changes are valid from the moment of publication on the website.
The owner undertakes to make the applicable terms and conditions always easily accessible on the website www.kolpa.tavio.si
